These Terms & Conditions (“Terms”) govern your access to and use of the website gkl.co.in(the “Website”) and the purchase of any products or services offered by Grophun Kidz Learning(“GKL”, “we”, “us” or “our”). By accessing the Website, creating an order, or making a payment, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. About us

Grophun Kidz Learning is an early-childhood skill-development brand offering learning products, activity kits and skill-development programmes for children aged 2–12, based on Howard Gardner’s Multiple Intelligence Theory and the NEP 2020 framework. We are based in West Delhi, India.

2. Eligibility

The Website is intended for use by adults aged 18 years and above. Products purchased are for use by children under the supervision of a parent or guardian. By placing an order, you confirm that you are at least 18 years old and legally capable of entering into a binding contract.

3. Products, pricing & availability

• All prices are listed in Indian Rupees (INR / ₹) and are inclusive of applicable taxes unless stated otherwise.
• We make every effort to display product descriptions, images and prices accurately. However, slight variations in colour, packaging or contents may occur, and images are for illustration purposes.
• Products are subject to availability. We reserve the right to modify or discontinue any product, and to correct any errors in pricing or description, at any time without prior notice.
• In the event a product is listed at an incorrect price due to a typographical or technical error, we reserve the right to cancel the order and refund any amount already paid.

4. Orders & acceptance

Your order constitutes an offer to purchase. An order is confirmed only after successful payment and our acknowledgement by email. We reserve the right to accept or decline any order, in whole or in part, at our discretion.

5. Payments

Online payments are processed through Razorpay, a third-party payment gateway. We do not store your card, UPI or bank details on our servers. All payments are subject to the terms and privacy policy of the payment gateway. GKL is not responsible for any failure, delay or error attributable to the payment gateway or your bank.

6. Shipping, returns & refunds

Delivery of products is governed by our Shipping & Delivery Policy, and returns and refunds are governed by our Refund & Cancellation Policy. Both policies form part of these Terms.

7. Intellectual property

All content on the Website — including text, graphics, logos, images, the “Grophun Kidz Learning” name and mark, and the arrangement thereof — is the property of GKL or its licensors and is protected by applicable intellectual-property laws. You may not copy, reproduce, distribute or create derivative works from any content without our prior written permission.

8. Acceptable use

You agree not to:

• use the Website for any unlawful purpose or in violation of these Terms;
• attempt to gain unauthorised access to the Website, its servers or any associated systems;
• transmit any malicious code, or interfere with the proper working of the Website;
• submit false, misleading or fraudulent information, including during checkout.

9. Third-party links

The Website may contain links to third-party websites or services that are not owned or controlled by GKL. We are not responsible for the content, policies or practices of any third-party sites.

10. Limitation of liability

To the maximum extent permitted by law, GKL shall not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with your use of the Website or the products, whether based on contract, tort or otherwise. Our total liability for any claim shall not exceed the amount paid by you for the product giving rise to the claim.

11. Indemnity

You agree to indemnify and hold harmless GKL, its directors, employees and partners from any claims, damages or expenses arising out of your breach of these Terms or your misuse of the Website.

12. Governing law & jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts at New Delhi.

We may update these Terms from time to time. The revised version will be posted on this page with an updated “Last updated” date. Your continued use of the Website after any change constitutes acceptance of the revised Terms.
